Young ITA North America invites you to attend this in-person discussion about the challenges of managing parallel proceedings across jurisdictions.  It is not uncommon for parties doing business in Latin America to find themselves facing multiple proceedings spanning the civil courts, criminal courts, and arbitral tribunals. Parallel proceedings have the undesirable effect of potentially conflicting determinations and may be a waste of resources. This program will feature a dialogue between leading arbitration practitioners and in-house attorneys concerning practical actions which can be taken to avoid or mitigate conflicting decisions. The panel will discuss the remedies that may be available to parties as well as consolidation or joinder of proceedings when possible. 

#YoungITATalks is a series of events presented around the world, featuring talks, workshops or interviews that cover a wide range of subjects relating to arbitration. The #YoungITATalks series is designed for education, conversation and sharing knowledge and experiences among young practitioners.

Sandra Friedrich is a Lecture in Law at the University of Miami School of Law and the Director of Miami Law’s International Arbitration Institute and White & Case International Arbitration LL.M. Graduate Program. Previously, she practiced law at Latham & Watkins in New York, focusing on complex commercial and investment arbitration proceedings as well as related litigation. She holds law degrees from the University of Cologne (Germany), the University Paris I Panthéon-Sorbonne (France) and the University of Miami School of Law.

Katharine Menéndez de la Cuesta

Katharine Menéndez de la Cuesta is a litigator who handles international disputes and is based in Holland & Knight's Miami office. Clients rely on her experience to represent them in international arbitration proceedings in English and Spanish, and in litigation matters before U.S. federal and state courts in New York and Florida.

Ms. Menéndez de la Cuesta has handled international arbitrations applying the laws of New York, Florida, Illinois, Spain, France, U.K., Namibia, Saudi Arabia, Colombia, Venezuela, and Guatemala, among other jurisdictions, and administered by the main arbitral institutions, such as the International Chamber of Commerce (ICC), International Centre for Dispute Resolution (ICDR), and International Centre for Settlement of Investment Disputes (ICSID). She has acted as Administrative Secretary of arbitral tribunals, is acting as an arbitrator appointed by the investor in an investor-State arbitration, and was a representative for North America of the ICC's Young Arbitrators Forum (YAF) for its 2019-2021 mandate.

Jorge A. Mestre engages exclusively in a commercial-litigation practice and is Board Certified in International Litigation and Arbitration by the Florida Bar. In Chambers USA, he has been praised for “his strategic sense and creative thinking in critical litigation matters” and has been characterized as “a brilliant litigator with the creative edge; he sees a tactical advantage in what seems like an intractable problem.”

A seasoned practitioner, Mestre has litigated cases through trial in federal district court and Florida state court and has handled appeals before numerous state and federal courts. He has also litigated domestic and international arbitration matters in both English and Spanish, including an arbitration victory in Spanish. He has served as a party-appointed arbitrator in cases administered by the International Chamber of Commerce, the American Arbitration Association, the International Center for Dispute Resolution, and in an ad hoc international arbitration—experiences that give him a valuable understanding of how arbitration tribunals work.

Eve Perez Torres

Eve Perez Torres is in-house counsel for Chiquita Brands International Inc. based in Miami, Florida. Eve is an attorney in both the Republic of Colombia and in the U.S. barred in Florida. Eve structures, reviews, and negotiates a broad range of commercial contracts with local and international corporations. Eve also represents Chiquita in international arbitration proceedings and manages outside counsel both in the U.S. and Latin America. Eve’s extensive legal experience both in the U.S. and Latin America gives her a comprehensive understanding of how to efficiently manage legal and arbitral proceedings under both legal systems. Eve also supports efforts to promote racial equality in international arbitration serving as a Vice-Chair of the Committee on Conferences & Events for the R.E.A.L. (Racial Equality for Arbitration Lawyers).
