RELEASE, WAIVER OF LIABILITY AND ASSUMPTION OF RISK
Cross the Cut Ride (November 20, 2021)

I am freely participating, at my own risk, in Cross the Cut Ride hosted by Charleston Moves on November 20, 2021. Further, as the legal guardian of the child(ren) listed below, I acknowledge on their behalf and allow their participation, at their own risk, in Cross the Cut Ride hosted by Charleston Moves on November 20, 2021. I understand the risks inherent in this event, where a large group of people will be riding bikes in close proximity to each other. Additionally, I understand the risks of riding on a public roadway without designated bicycle facilities, and that I and any minors for whom I am waiving liability and assuming all risks will be sharing space with motorized traffic. I agree both on my behalf and on behalf of all minors for whom I have legal responsibility to assume all risk of bodily injury, death, disability, and property damage as a result of participating in this event. I understand that I am responsible for the maintenance and roadworthiness of my own and my child(ren)'s bicycle. Fully aware of all of these risks, I hereby assume the risk of participating in this event, and release and forever discharge the “Released Parties” (see definition in the next paragraph) for all claims of any kind that I or minors for whom I am contracting may have or later accrue because of participation in Cross the Cut Ride, including claims arising from the Released Parties’ own negligence.

The Released Parties include: 1) Charleston Moves and its respective officers, directors, shareholders, employees, agents, volunteers or sponsors; 2) the City of Charleston and its authorities and commissions, and each of their respective elected officials, members, employees, agents or sponsors; 3) and each of the respective landowners and operators of properties, public and private, on which the event will take place, and each of their respective members, officers, elected officials, directors, shareholders, employees, agents or sponsors.

I execute this release, waiver and assumption of risk on behalf of myself and minors for whom I have legal responsibility. I waive all claims released by this agreement and promise not bring nor permit others to bring any such claims on my own or the minors’ behalf, and agree to indemnify all of the Released Parties against their respective costs of defending any such claims, including reasonable attorney fees. Neither myself, nor the minors for whom I am contracting currently has a medical condition, physical or mental, that would impair our capacity to participate in this event. If any portion of this Release, Waiver, and Assumption of Risk should be held unenforceable for any reason, the remainder shall remain in full force and effect. This Release, Waiver, and Assumption of Risk shall be governed by the laws of the State of South Carolina.

I hereby grant Charleston Moves full license to use photographs, video recording or other media of myself and the minors for whom I am acting participating in Cross the Cut Ride. By signing this waiver, I confirm that I have read, understand, and consent to the terms of this waiver agreement.
